E-Verify Ends Extended Timeframe to Resolve SSA Mismatches

Employees whose E-Verify cases are referred to the Social Security Administration (SSA) on or after July 15, 2022, will have eight federal government work days to contact their local SSA office to begin resolving a tentative nonconfirmation (TNC) mismatch [E-Verify, Social Security Administration Resumes E-Verify Operations, 7-5-22].

Staggered Referral Dates

E-Verify had extended the timeframe for employees to take action to resolve SSA mismatches due to office closures during COVID-19. Employees with E-Verify cases referred between March 2, 2020, and July 14, 2022, with SSA mismatches will have until September 29, 2023, to resolve the case or they will receive a final nonconfirmation automatically. Employers should review employees’ original Referral Date Confirmation (RDC) and update RDC notices with the new final date (September 29, 2023).

While all nonconfirmations must be resolved by September 29, 2023, SSA has staggered dates by which employees should contact the agency to resolve the discrepancy. Here are the dates when employees should contact SSA:

  • If the RDC is dated from March 2 to December 31, 2020, the employee should contact SSA between October 1 and December 31, 2022.
  • If the RDC is dated from January 1 to December 31, 2021, the employee should contact SSA between January 1 and March 31, 2023.
  • If the RDC is dated from January 1 to July 14, 2022, the employee should contact SSA between April 1 and June 30, 2023.

Employers should tell employees of the preferred dates and provide them a copy of the updated RDC. Although the dates are preferred, not required, all employees must visit SSA to resolve their mismatch by September 29, 2023.
